“Special education means specially designed instruction, at no cost to parents, to meet the unique needs of a child with a disability, including instruction conducted in the classroom, in the home, in hospitals and institutions, and in other settings; and instruction in physical education. Special education includes each of the following if the services otherwise meet the requirements of the first paragraph: speech-language pathology services, travel training, and vocational education. [34 CFR 300.39(a)] Special education does not include general education procedures that are a part of formal general education intervention as elsewhere referenced in these rules.” (05-071 Chapter 101, Maine Unified Special Education Regulation)

Also known as Parental Rights, these are the rights parents have if they have a child who may, or may not have a disability.
RESTRAINT & SECLUSION (RULE CHAPTER 33)
“This rule establishes standards and procedures for the use of physical restraint and seclusion. Physical restraint and seclusion may only be used as an emergency intervention when the behavior of a student presents a risk of injury or harm to the student or others. The rule sets forth permitted and prohibited uses of restraint and seclusion, required notification and documentation of incidents of restraint or seclusion, aggregate reporting of incidents to administrators and the department of education, notification of parents, response to multiple incidents of restraint or seclusion of a student, local and state complaint processes and department approval of training programs.” (05-071 Chapter 033)

DESTRUCTION OF RECORDS
Annually the district destroys special education records for former students turning 26 in that calendar year. If you would like to pick up your (or your child’s) special education records, please contact the Special Services Office. A mandatory Annual Notice is posted in local papers prior to destruction of records each summer.
